Amendments to Land Acquisition (Just Terms Compensation) Act (NSW)
These amendments recently passed through Parliament and are shortly to commence.
The amendments include increasing the maximum amount for solatium (renamed disadvantage resulting from relocation) to $75,000.00, providing for a minimum period of time for negotiation prior to initiation of compulsory acquisition process, an independent review under the hardship provisions and provision for market value to include the value of purchasing replacement land where there is no general market for the land being acquired (e.g. community land held by Councils).
